FIFA own legal system


FIFA has successfully developed its own private legal system – now governments must step in

The World Cup was a success, especially for France, Russia – and FIFA. But the football world’s governing body cannot rest on its laurels.

After all, one better-than-expected tournament cannot erase a series of major scandals. These include the infamous decision by its executive committee to award the 2022 finals to Qatar. This was followed by FIFAGate, a money laundering and fraud conspiracy case under investigation by US and Swiss authorities that has already resulted in the convictions of several top football officials, and the suspension of former FIFA chief Sepp Blatter.

This all damaged FIFA’s credibility. Some of the organisation’s critics even called for radical action, such as abolishing FIFA altogether.

Somewhat ignored in these discussions, however, is that FIFA has successfully developed its own private legal system. And while this is generally a good thing for the game, it also leaves the organisation dangerously free of accountability to governments, or civil society.

FIFA’s own rules, which govern the world of football, have an almost unique degree of sophistication and independence from state interference. Clubs, players and even national teams are bound by these rules.

When Ronaldo recently moved from Real Madrid to Juventus, the reported transfer compensation of €100m was agreed under FIFA transfer rules – not Spanish, Italian or EU law. A similar arrangement in any other field seems unthinkable. Associations of lawyers, for example, cannot issue rules that require law firms to pay compensation if they hire a lawyer from a competitor.

Similarly, football disputes are usually not solved in regular courts but in special sports arbitration tribunals. The enforcement of FIFA’s decisions is not backed by the force of state officials but by special sanctions such as temporary bans from playing football. Instances of national or international government interfering in football, such as the Bosman ruling in the 1990s, which allowed players to change clubs freely at the end of their contract, are extremely rare.

Our own research shows that FIFA’s private legal system is good for football because it offers what states cannot: common rules spanning across borders that are tailored to the needs of the sport. These rules promote predictable contractual relations and equal conditions for competition – and they provide for swift dispute resolution away from regular courts. It is hard to imagine how football clubs could compete internationally had some of them been subject to more favourable local rules than others.

The rise of football’s elites
Yet the fact FIFA has been able to build its own legal system, with minimal oversight, has left it vulnerable in the longer term. Recent scandals are in part a result of a power grab by some football bureaucrats who want to increase their own influence and extend their stay in office.

In this regard, FIFA is similar to any other bureaucratic organisation. The difference is that others are subject to transparency, media coverage, and the disciplining effect of civil society. For a long while, FIFA was mostly immune to these factors.

Its success in building the legal system for football relied on states and supra-national organisations such as the EU giving away part of their monopoly on regulation. Implicit in this arrangement is the idea that FIFA’s special status can be tolerated as long as it continues promoting the interests of broader stakeholder groups – mainly clubs and players, but also others involved in the game.

But FIFA’s credibility as an impartial regulator is weakened every time it gives priority to one group over another or even promotes special interests within a group, such as deferring to the demands of big clubs at the expense of smaller clubs. This is why external legal investigations such as the FIFAGate corruption case are so damaging, and endanger the existence of football’s bespoke legal system and even FIFA itself.

Those investigations will keep coming, thanks to governance issues within the organisation. Clubs and players sometimes lack formal channels to get involved in decisions that affect them directly, for instance while FIFA also has no proper mechanisms in place to consider the interests of anyone not related to football. As third parties have no say in the rules, their interests may be ignored. Consider, for example, the alleged use of forced labour in venues that will stage the 2022 World Cup in Qatar.

Building a better FIFA
So what should we do about elites with excessive powers? Within a nation state, it is well known that civil society plays a key role in limiting executive power. Modern democracies are successful because they have a democratic process in which the media, NGOs and campaigners oversee public decision-making. But there are no similar mechanisms in place for FIFA.

But if football does not yet have an equivalent civil society, states themselves should step in. As we argue in a recent paper, governments can be FIFA’s civil society by intervening or threatening to intervene to correct the failures of FIFA without ruining its benefits.

If FIFA were to collapse and football became governed by regular laws, the game would lose the benefits of tailored rules and innovation. Conversely, if states do not act, FIFA runs the risk of self-destruction.

As the world begins reopening with caution amid the COVID-19 pandemic, Universal Tennis is doing its part to improve morale by safely bring tennis competition back to the forefront with a brand new initiative.

ATP world No. 8 Matteo Berrettini, WTA Top 20-player Alison Riske and rising star Amanda Anisimova headline the launch of the UTR Pro Match Series presented by Tennis Channel, a string of three-day prize money competitions marking the first live major sporting event with world-class athletes to air nationally in the U.S. since country-wide social distancing and isolation measures came into effect.

Held in the West Palm Beach, Fla. area, there will be no public access to the matches, which meet Tennis Integrity Unit (TIU) compliance standards. A chair umpire will be present, with players receiving their own set of marked balls and designated off-court areas, while being responsible for providing their own drinks and towels.

Every match will air live on Tennis Channel and count toward a player’s UTR rating. The men’s tournament is set to run May 8-10, as Americans Reilly Opelka, Tennys Sandgren and Tommy Paul join 2019 US Open semifinalist Berrettini, who has been staying in Florida since mid-March. In addition to Riske and Anisimova, the debut women’s tournament, slated for May 22-24, features former Grand Slam semifinalist Danielle Collins, along with Australia’s Ajla Tomljanovic.

“The world has changed and we must adapt and innovate,” said Universal Tennis Chairman & CEO Mark Leschly. “Local, individual and small group play will be the new normal for the foreseeable future. The UTR Pro Match Series showcases how tennis can be played locally, safely and have results count toward the UTR global rating.”

Andy Roddick, whose charisma and quick thinking has seamlessly harmonized with the Tennis Channel Live team over the past two months, will provide commentary via Skype to kick off coverage on Friday, May 8. Competitors will provide insight to Los Angeles-based Brett Haber and Prakash Amritraj throughout the event by utilizing headset technology.

“We’re excited to work with our longtime partners UTR to bring professional tennis and high-quality live sports coverage back to millions of tennis fans in the United States and Europe during this uniquely challenging moment,” said Ken Solomon, president of Tennis Channel.

Italy's Berrettini will be making his first appearance since being upset by Sandgren in the second round of the Australian Open. Sandgren went on to reach his second quarterfinal at Melbourne Park, where he held seven match points over Roger Federer before falling to the Swiss in a five-set heartbreaker. Just before tour-play was suspended, Opelka triumphed at his hometown event in nearby Delray Beach for his second ATP title, while Paul climbed to a career-best No. 57 on March 2.

Riske, who lost to world No. 1 Ashleigh Barty in the round of 16 Down Under, was in Olympic-qualifying position as the No. 4-ranked American woman when the rankings were frozen. Anismova, No. 28, knocked off world No. 7 Elina Svitolina in her last match before withdrawing from Doha with gastrointestinal illness. Tomljanovic is currently stationed at the Evert Tennis Academy in Boca Raton with Berrettini, and Collins is a native of St. Petersburg, roughly 200 miles northwest of West Palm Beach.

Universal Tennis intends to expand the series internationally, with Tennis Australia already planning events based around local guidelines and restrictions.

Deontay Wilder NOT Stepping Aside For Fury Vs. Joshua Mega-Fight

 ESPN is reporting that preliminary negotiations have begun for a heavyweight unification clash between Tyson Fury and Anthony Joshua in December in the Middle East. Unfortunately, the discussion could be a waste of time due to the management for Deontay Wilder NOT showing interest in stepping aside. 

 

Likewise, Kubrat Pulev, Joshua’s IBF mandatory challenger, isn’t saying he’s going to step aside either. Joshua has to face Pulev due to him being his mandatory. If Joshua wants to keep his IBF title, which he does, then he’ll need to face Pulev next.

Unfortunately, Pulev, 38, isn’t showing interest in stepping aside to let Joshua fight Pulev, and Wilder isn’t saying he’ll step aside either. Why would they? It’s in Pulev and Wilder’s best interest to go ahead with their planned fights against Joshua and Fury.

 

While the news may have initially gotten Fury and Joshua’s boxing fans excited about the colossal match-up, it doesn’t have much of a chance of taking place. Wilder’s manager Shelly Finkel has already commented on the Fury-Joshua negotiations by pointing out that Wilder is STILL facing Fury next.

They have a contract for Wilder to face Fury, and he apparently won’t be stepping aside to let the fight take place between the two giant British heavyweights.

WILDER’S NEXT FIGHT WILL BE TRILOGY AGAINST FURY
“As far as we’re concerned, the next fight [for Wilder] is the third fight [with Fury],” Finkel said to ESPN.com.

So there it is. All that excitement about the Fury vs. Joshua fight being put together in 2020

Fury’s promoter Bob Arum is waiting on offers from the Middle East to stage the Joshua fight in one of those countries. Saudi Arabia is one option, but again, it won’t happen unless Pulev and Wilder both agree to step aside.

 

Wilder should take the fight with Fury as soon as possible rather than having to wait until 2021 after he faces Joshua. Wilder’s reputation is in tatters after his seventh-round knockout loss to Fury last February in Las Vegas, and it’ going to stay that way until he avenges the loss.

By Wilder waiting an entire year before facing Fury, the image the boxing fans have of him will be what they saw in his loss. It’s far better for Wilder to get back in the ring with Fury immediately to show that he’s not the same guy that he blew out of the ring.

Wilder has already made several excuses for his loss, and he’s taken a lot of heat over that. But if he beat Fury in 2020, then the fans will say, ‘You were right, Deontay. The excuses that you made for your loss were correct.’

HEARN SEES JOSHUA VS. FURY LIKELY FOR 2021
While the management from Fury’s side is talking up putting a fight together with Joshua in 2020, A.J.’s promoter Eddie Hearn is saying the mega-bout has a better shot of taking place in 2021.

Hearn’s main issue is the crowds being allowed into sporting events by November or December of this year. The pandemic is still going on, and it could be foolish to assume that the Commissions and the government will give the green light to less massive crowds attend sporting events.

Whether the idea of staging the Fury vs. Joshua fight in the Middle East is a way of circumventing the U.S. and U.K. governments is still uncertain. But it makes more sense for the battle to take place after the government allows crowds back into boxing events, be it in 2021 or 2022.

That doesn’t mean the Joshua-Fury fight still can’t take place. It just means that they might need to do it behind closed doors, which they probably won’t consider due to the loss of the enormous gate.

“There’s more chance at the moment that the bigger money could come next year because we don’t even know if we can do live crowds in November, December,” said Hearn to ESPN.com.

JOSHUA-FURY MAKES MORE MONEY LATER
Hearn can’t know for sure whether 2021 will be any better than 2020 in terms of the money for the fight. Under a worst-case scenario, the pandemic will still be present for another two years before it finally abates.

So, we could be looking at 2022 before things are back to normal. That would be the same normal that we saw before the pandemic began.

The U.S. and U.K. economies will likely be still reeling by 2022, so the big money that Hearn and the promoters are projecting for the Joshua vs. Fury fight might not be as much as they initially thought it would be.

Ideally, the management for Joshua and Fury should put off this clash for as long as possible until well after the pandemic ends. Even putting it off until 2023 might be a better option than staging it in 2020 or 2021 while the sickness is still spreading.
